Terms of Use for EveryDataStore ECM

These Terms of Use govern the use of the EveryDataStore ECM software, provided by EveryDataStore GmbH, Gallgasse 83, 1130 Vienna, Austria (hereinafter referred to as the "Provider"). By using the software, you agree to these terms. Please read them carefully.

1. Definitions

  • "Software": The EveryDataStore ECM application, consisting of backend, frontend, and mobile app.
  • "EveryRestAPI": A plugin that enables communication between software components; partially subject to a fee.
  • "User": Any natural or legal person using the software.
  • "Named User": A specifically assigned user who holds a valid license.

2. Open Source Components

The core functionalities of EveryDataStore ECM are open source. The source code is available free of charge via GitHub. Use, modification, and distribution are governed by the applicable open-source license.

3. Scope of the Software

EveryDataStore consists of three components: backend, frontend, and mobile app. The EveryRestAPI plugin acts as the interface between them.

The use of EveryRestAPI is free up to the following limits:

  • Maximum 5 users
  • 1 DataStore
  • 10 RecordSets
  • 10,000 RecordSetItems

Beyond these limits, a paid license is required.

4. Disclaimer of Liability

EveryDataStore GmbH assumes no liability for damages arising from the use of the software. This particularly applies to damages resulting from the use of open-source code or third-party components. The use of the software is at your own risk.

5. Licensed Plugins

Some plugins of EveryDataStore are subject to licensing fees. Their use requires a Named-User License:

  • The license is valid for one year.
  • Annual renewal is possible.
  • Support and SLA are not included.
  • Plugins may not be modified or resold.

6. SLA & Support

SLAs and support apply only to paid plugins. Costs depend on the project size. There is no obligation to provide support for unpaid or unlicensed plugins.

7. Payment Terms

  • Currency: Euro
  • Billing: Annually via invoice
  • In case of non-payment, the Provider is not obliged to continue providing SLA, support, or license services.

8. Updates

  • Major releases are issued twice a year: end of Q1 and end of Q4.
  • Code bugs are fixed and published continuously, regardless of release cycles.

10. Use of Demos

Demo versions are provided exclusively for testing purposes.
During the demo phase, EveryDataStore GmbH will answer user inquiries.
There is no entitlement to a free extension or support after the demo period.

11. Use of AI Solutions

Our plugin EveryDocumentParser uses an AI solution provided by a third party.
For commercial use, you will receive access credentials from us, enabling you to control where and how long your uploaded documents are stored.

In the demo version, the AI operates in test mode. Documents are deleted after upload.

12. Governing Law & Jurisdiction

These terms are subject to Austrian law. Jurisdiction is Vienna, Austria.
